Ignored By Media: CA. State Rules To Follow State–Not Federal Laws
Ignored by the media, the long awaited state ruling has finally come to an end!
Good news for California, and the marijuana community. The California Supreme Court has ruled that California is to follow STATE laws and not Federal Laws. This applies to any events or situations in California regarding federal and state law conflict. ( on short, California medical marijuana patients can defend their use and cultivation of marijuana with the defense of the state. Also Medical marijuana dispensaries now can open and operate without any city hassles!)
Although Marijuana is illegal according to the federal laws, California passed Prop 215 in 1996, California law enforcement has claimed that they could not comply with the state’s medical cannabis laws because they conflicted with federal law, and would take the right action to follow federal law. Regardless of state exceptions of medical marijuana police would still arrest patients, even though the state constitution explicitly says in Article , Section 3.5 (adopted in 1978) that:
“An administrative agency, including an administrative agency created by the Constitution or an initiative statute, has no power: … (c) to declare a statute unenforceable, or to refuse to enforce a statute, on the basis that federal law or federal regulations prohibit the enforcement of such statute unless an appellate court has made a determination that the enforcement of such a statute is prohibited by federal law or federal regulations.”
Finally this big conflict between federal and state laws has ended. California has set to follow the Constitution to obey and enforce state laws, not federal. Many cities and towns in California have had many problems to open and operate a medical marijuana coop’s due to this conflict between federal and state laws, this will not be an issue anymore. This actually will help California dispensaries defend their Co-op from federal raids. Also, medical marijuana patients will be able to defend their cultivation and use of marijuana safely and with the defense of the state courts! Hopefully this is a step forward in protecting medical marijuana in the United States.

When the New Hampshire House of Representatives voted to decriminalize the possession of small amounts of marijuana, it was the first time the legislative body approved reducing the penalty for having pot.
But the bill is unlikely to become law. It has little support in the Senate, and Governor John Lynch has said that he will veto this bill if it reaches his desk and now requested that this matter to be on pause. “it sends the wrong message to the state’s young people about the dangers of drugs” What a load of crap!
This is probebly because about a week ago after the bill was passed, Deputy Scott Burns said that New Hampshire House Bill 1623, which would decriminalize the possession of 1/4th ounce, would legalize the “manufacturing” and “distributing” of “over 90 marijuana joints.” Everyone knows these statments are just false! its just another way to keep the Anti-marijuana movement alive. The New Hapshire bill doesn’t even decrimanalize the sale of marijuana at all. Deputy Scott Burns just dug himself in lies. Now everyone will know.
The bill makes possession of a quarter of an ounce or less of cannabis a civil violation of $200 fine, instead of going to jail and paying fines up to $2,500. So Governor Lynch believes it is a good idea to keep these ridiculous laws. Obviously he is from the old generation of the brainwashed society. The force is just to strong to just ignore the marijuana situations of today. Though the House Criminal Justice and Public Safety Committee recommended against passage of the law, the bill passed the full House, 193 to 141, on March 18.
Also, Representative Barney Frank said last week that he will file a bill in the US House to legalize “small amounts” of marijuana. Nobody was more surprised when the New Hampshire House passed the bill than Jeffrey Fontas, the 21-year-old Democrat from Nashua who cosponsored the legislation.
“Many people told us that it wouldn’t pass, but it did. I think it was because of the way we framed the argument. Mistakes early in life, like a possession charge, can be devastating to the futures of our young people,” he said, adding that a single drug arrest can lead to the loss of a college scholarship, the ability to serve in the military, and the chance to qualify for subsidized housing and food stamps.

The voters of California said yes, the federal government says no. Tuesday supporters of medical marijuana are saying enough. They want the feds to stop what they claim is the unabated harassment of medical marijuana dispensaries and the patient that use them. Christina. Many in Compton, North Hollywood, and Los Angeles area rally to protest the DEA raids on local medical marijuana dispensaries in downtown. A doctors office that offers medical marijuana recommendation was raided by the DEA and all medical history and records were taken. Even the medical office next door was also raided and its medical history seized. The federal government says that even though California and many other states have passed the bill to legalize medical marijuana, it is still a Federal Crime. Hopefully Rep. Barney Frank and Norml as a team push the new bill Barney Frank has written to finally Decriminalize Marijuana by federal law.
This is just the ways the federal government twists the constitution, stating that under federal law its illigal but clearly through the constitution we all have the right of medical marijuana if our states pass the bills to accept it. Finally One of the biggest Marijuana law reform organizations (NORML) has teamed up with Rep. Barney Frank (D, MA) to introduce federal decriminalization legislation! This is the big step the marijuana community needed to decriminalize around the nation. This will cause a ripple effect around the world, and cause other countries to start decriminalizing marijuana as well! For the first time in more than two decades, we will soon have legislation in Congress that, if enacted, would finally end the federal prosecution of adult marijuana users. This would eliminate all federal penalties prohibiting the personal use and possession of up to 100 grams (3 1/2 ounces) of marijuana. Also, this bill eliminates, adults who consume cannabis would no longer face arrest, prison, or even threat of civil fine. This bill also eliminates all penalties prohibiting the not-for-profit transfers of up to one ounce of marijuana. After long debates regarding federal law and state law, Barney Frank still defends to decriminalize Marijuana as of today march 24 2008. Frank says it should be left to the state to agree if drug policies should exist or not, and not up to the federal government. Franks says he is following the written constitution that: State’s can create their own laws and policies, and should be followed if a resident of the state. The DEA says that federal law is top priority, than state law.
Frank, who filed a bill to decriminalize marijuana as a member of the Massachusetts Legislature in the 1970s, said the decision whether to make possession of the drug illegal should be left up to the states. He also said the federal government shouldn’t have a law on the books that is rarely enforced and which doesn’t make sense to large portions of the public. “Do you really think people should be prosecuted for smoking marijuana? I don’t think most people agree with that. It’s one area where the public is ahead of the elected officials,” Frank said in an interview with The Associated Press. “It does not appear to me to be a law that society is serious about.” Frank said he was particularly troubled by federal law enforcement agencies targeting those using marijuana as a legal medical treatment under California law. I don’t think smoking marijuana should be a federal case,” he said. “There’s no federal law against mugging Marijuana use is illegal under U.S. law, which does not recognize the medical marijuana laws in California and 11 other states.

Do you think its fair that innocent people should go to prison for 4 years simply for having a small marijuana joint on them? Do you think its worth our tax paying money to fund something that puts innocent people in prison? Also that doesn’t even help? its been 94 years and the “War on Drugs” has not ended, and never will. L.E.AP also thinks its time to stop the prohibition.
Now law enforcement officers agree that this prohibition for drugs and marijuana is just too costly and even getting to dangerous for them as well. L.E.A.P Law Enforcement Against Prohibition is organization of law enforcement officers that are trying to educate the congressman of the united states of personal experience. The congressman are not the ones who deal with the wasteful “War on Drugs” that’s been going on for 94 years in the United States, but the police officers. A retired policeman and detective Howard Wooldridge of Lansing, Michigan is a supporter of L.E.A.P and has researched and interviewed many senators about the “War on Drugs”. “U.S. taxpayers do not understand the incredible deception perpetrated on them by the Drug War. Officer Wooldridge talked with Senator Biden (D-DE) last month. Senator Biden (D-DE) said at a hearing in February 2008 that drug prohibition touches 60 percent of all crime in America. Wooldridge advised to dramatically reduce crime, death, disease and drug use, the U.S. must end the prohibition approach on the 10 most used drugs.

Barney Frank a Massachusetts Democrat said during an appearance on HBO’s “Real Time with Bill Maher”, that he will soon introduce legislation to decriminalize small amounts of marijuana in Massachusetts. This is Franks second time trying to push the legislation to the House floor for voting, but Frank offered no details on his legislation. Frank also stated on the show that the American public has already decided that personal use of marijuana is not a problem. Will Barney Frank be successful this time around?
(The Politico) Rep. Barney Frank will soon introduce legislation to decriminalize small amounts of marijuana, the Massachusetts Democrat said during an appearance on HBO’s “Real Time with Bill Maher.”
Frank offered no details on his legislation, and it’s not at all clear that he could ever get it to the House floor for a vote. A Frank aide was unaware of his plans other than his statement on HBO.
Frank has introduced legisaltion in previous years to allow the use of “medical marijuana,” although the bills never made it out of the House Energy and Commerce Committee.
Asked by Maher as to why he would push a pot decriminalization bill now, Frank said the American public has already decided that personal use of marijuana is not a problem.
“I now think it’s time for the politicians to catch up to the public,” Frank said. “The notion that you lock people up for smoking marijuana is pretty silly. I’m going to call it the ‘Make Room for Serious Criminals’ bill.”
